National Vaccine Injury Compensation Program (VICP)

I currently have a lawyer working with me to file a case with the “VICP”. It takes a long time… not only to get to the decision that you have a case to the actual filing of the case.
My lawyer is from PA. I live in MN. So far I filled out a general form to see if I have a case. Then they called and talked to me, Then had me sign forms to get my medical records. Once records were there the paralegel looked over everything to make sure every record was there. Then the file was given to a lawyers pannel to see if I have a case. Once completed with that lawyers panel, then my file went to a medical panal.
So at this time, the medical panal decided I do meet the stringent guidlines.
Keep in mind that if anyone gets any money (it takes years to get to that point) the person is paid from one fund. The lawyers are paid from a different fund. The judges who make the decision specialize in Vacine cases.
Is it worth it.. YES! The Tdapt vacine was my downfall with GBS along with the complications. I also have asept meningities — I was algeric to the IvIG. Thyroid cancer, and who knows what comes next. I am on disability and SSI.

Jules, I live in MN and I got CIDP from the seasonal flu vaccine in November 2010 and am thinking about persuing a law suit. Would you mind telling me the name of you lawyer in Minnesota? I don’t know where to start on a lawsuit and a name of a lawyer would really help.

I have a lawyer and a claim filed under the H1N1 program which is different than the VICP. I am in the very preliminary stages. Another member on here named John gave me the referral and 2 of us that got the H1N1 shot are using this firm. John was successful with recovery for another vaccine injury. I am in Chicago and these attorneys are in Boston. It does not matter because it is a federal filing. Here is the name of the firm that I am using. You have one year from the H1N1 to file and 3 years from any other vaccine.

The “VICP” also pays if a loved one has passed away.

I did contact Conway, Homer & Chin-Caplan and they did think i have a good case against the vaccine recovery fund. I just got done filling out the paperwork they sent me and sent it back to them. Now I wait and see what happens if I do get to go forward with a case or not. I know this is a very long process and I may not win but it feels good to be doing something. I was wronged by the flu vaccine. It has ruined my life! I was a very healthy woman before the flu vaccine and now I live with constant pain, numbness, not to mention the anxiety and depression that goes along with the CIDP. My life has been turned upside down. I am not very disabled at this point as I have a mild case of CIDP but who knows what will happen in the future with my CIDP. I could lose my job, end up disabled, lose insurance coverage, IVIG stop working for me…the list is endless. So any compensation would be appreciated as I would have a little cusion of money to rely on if something bad does happen in the future.

My neurologist informed me of the VICP program the second day after my diagnosis. He stated he will make sure his documentation will support my case. He also gave my wife the phone number of a lawyer who he has worked with on these cases. You have to wait 6 months before filling. If anyone has received an award and care to share the amt of the award, or the range of the amt I would appreciate it. Sure could use a pick me up about now. Thanks.

What is the difference between the H1n1 program and the VICP program? I never heard of the H1N1 “program”

Does anyone know if you pay taxes on the award settlement?

No, you do not have to pay any taxes on the settlement. And my lawyer fees are paid by the fund too. So there is no fee to me. If my case did not go to filing, then I would have had to reimburse the law firm for the collection of my medical records. But since my case was filed then the fund also pays for the medical recored collection fee. I am still awaiting on my judgement. The lawyer said that it is filed and in the decision stage. I will get compensated but we are hagling back and forth on the amount and trying not to actually go to trial – settle out of court. It took three years to get to this stage. But no matter what I am awarded it won’t take my CIDP away and resore my life to what is use to be. But any funds I do get in the settlement will help me with my medical out-of-pocket expenses that I now have because of CIDP. I am not sure if I filed under VICP or H1N1 – I left that up to my lawyer. They file vaccine related cases and nothing else so they have a lot of experience in this area.
